The number of women on high courts across the globe has been steadily increasing. Recent estimates found that women now make up 61% of the judiciary in European countries (Organisation for Economic Co-operation and Development 2019). The large number of women now serving in judicial positions has resulted in a changing demographic makeup of courts. While the majority might think this is a step forward for diverse representation, there is ultimately a dichotomy between judicial accountability that comes as a result of increased diversity in descriptive representation and judicial independence. Given this dichotomy, along with the increase in women on courts, it follows that the public’s perceptions of courts’ independence has the potential to change. We explore this phenomenon by asking the following question: How does the presence of women on high courts impact perceptions of judicial independence among the public? Using survey data gathered from respondents in twenty-seven European countries from 2016 to 2022, we examine how the dynamics of an increasing number of women on high courts alters the public’s perceptions on the level of independence of the court in their country. We draw from literature on judicial independence as well as women political elites and corruption. Importantly, we document that increasing the percentage of women on courts results in higher perceptions of judicial independence for women. Overall, our findings highlight important trends regarding gender diversity in political institutions and how changes in descriptive characteristics shape perceptions of judicial independence.
What is a populist judge, and when do judges embrace populism? Populist judges bypass legal and procedural constraints, seek an unmediated relationship with the public, and claim to represent the public better than political elites. Judicial populism can emerge in response to institutionalized dissonance in the political system. Dissonant institutionalization facilitates contestation between state institutions and can undermine the legitimacy of political institutions. This legitimacy crisis can imbue judges with a belief in their role as representatives of the public interest. In Pakistan, the dissonance caused by unresolved differences between the civil-military bureaucracy and the elected political leadership—differences that were embedded into the constitutional framework, facilitated the rise of judicial populism. I outline the key features of judicial populism and study the dynamics surrounding the rapid expansion of populist jurisprudence between 2005 and 2019 in Pakistan, with a focus on public interest litigation that became the cornerstone of the judiciary’s populist turn. Through case analysis, archival research, and semi-structured interviews, I discuss features of the populist approach to jurisprudence and trace how dissonance within Pakistan’s political system created new opportunities for the judiciary and changed judicial role conceptions within the legal and judicial community.
Chapters Three concludes the study of this political and constitutional transition by exploring the most important legal reform of this time: the Indian Penal Code (1860). Codification represented a highly political exercise that established the terms of the relationship between the subject and sovereign in India, while also further entrenching ideas of colonial difference into the everyday administration of criminal justice. In this chapter, I first examine how the crisis of 1857 shaped the final design of the IPC. I then pay close attention to the figure of the judge and the institution of the jury. I argue that colonial ideas of caste, culture, race, and gender informed the distribution of discretionary authority across the code in ways that would prove consequential for the administration of colonial justice.
